Zoning Bylaws are a significant regulation, restriction and even prohibition on the use of land. Yet, no Zoning Bylaw can anticipate every situation for every property, and most generally acknowledge there should be a simpler and faster process than bylaw amendments to achieve compliance. The Provincial statutory scheme contemplates VARIANCES and the Local Government Act (LGA) provides ample opportunities, including requiring local governments who have zoning bylaws to establish a Board of Variance. There are even two ‘kicks at the can’ for a property owner to apply to a different decision making body if not successful before one decision-making body. But there are a myriad of rules, procedures and contextual considerations for each community, as some local governments use more from the LGA Part 14 Planning and Land Use Management toolbox than others. Also relevant is the appropriate conduct of planners managing these systems. And, of course, it is not just zoning; some other bylaws can be varied, and even supplemented, depending on the variance procedure.

This Carvello on... full day workshop focuses on the procedures, law and practice of Variances (outside of Vancouver) and the two most common tools: the Board of Variance and the Development Variance Permit. But we also review variances within the Development Permit and Heritage Alteration Permit systems. Reading the LGA is not enough as much has developed through the courts.
The workshop is split into two parts: The first half is for Planners, Corporate and Administrative staff that implement the various variance opportunities. The second half is focussed on the Board of Variance, providing valuable training not only for local government officials, but also members appointed to a Board of Variance. BOV members should register for the second half only; other local government officials should register for the entire workshop to put it all in context.

All registrations are final.  No refunds or cancellations are permitted; however, in the event that a registrant is not able to attend, substitution of a different attendee may be accepted if arranged in advance.  Any registrant requiring substitution should contact PIBC.
